The superintendent or designee may approve joint use of facilities for up to one (1) year with payment to be assessed on a nondiscriminatory basis within classes of users. Services to students and/or building improvements may be accepted as partial payment, to be evaluated on an individual tenant and building basis. Joint use agreements for longer than one (1) year may require approval by the Board. No joint use agreement shall obligate the district to expend any funds on maintenance or improvement of the site or building; all maintenance and improvements shall be incorporated into the rate structure or made the responsibility of the lessee, with lessee's improvements subject to prior district approval and acceptance following completion. All leases or rentals executed pursuant to the above shall include provisions which permit the recapture of the leased or rented facility on fair terms should such property be needed for school purposes. Joint use agreement rental rates will be sufficient to pay average district costs (maintenance, operations, insurance, administrative overhead) plus a rental fee based on fair return. Process for Offering Property for Lease The superintendent or designee may consider proposals for lease of space from other governmental entities, nonprofit corporations and private parties. The superintendent or designee may select any or none, of the proposals so offered, or may select proposals modified through negotiations in accordance with determination of the best interest of the district. Among the factors to be considered by the superintendent or designee in making such determination shall be rate of return (either cash or building improvements which the superintendent or designee determines will benefit the district), compatibility of use with eventual return of the site to school use, and community and social benefits. |
